Another step on 3G road: Senate approves unified regulator law

The Thai Senate has approved the draft law on the establishment of the National Broadcasting and Telecommunications Commission (NBTC), in a move which clears another fragment of red tape in satisfying the necessary conditions to hold a long-overdue 3G mobile licence auction.

The Senate also set up a 35-member committee, chaired by PM’s Office Minister Satit Wongnongtaey, to review the bill, which should be completed in 30 days.

The NBTC will be made up of eleven commissioners, including two telecoms industry experts, two lawyers, two economic specialists, two consumer protection officials (one each for telecoms and broadcasting), and one expert each in the areas of radio, TV and education/culture.

The selection process will involve qualified organisations proposing 22 names and a 15-member committee, comprised of representatives from state agencies and ministries, proposing another 22 qualified personnel. The Senate will then appoint those chosen and officially form the NBTC.

An auction of 2100MHz network operating licences is tentatively scheduled for November 2010; existing telecoms regulator the National Telecommunications Commission (NTC) has had its hands tied by a legal dispute over its jurisdiction to issue 3G licences ahead of the delayed formation of the new unified telecoms and broadcasting watchdog.

Draft bill to establish new regulator to be submitted

After ten months of negotiations the draft bill on allocating broadcast frequencies and the setting up of the National Broadcasting and Telecommunications Commission (NBTC) has been finalised, and will be submitted to the House of Representatives on 21 January.

The new regulator will have sole authority in deciding who will receive communications frequencies currently mainly controlled by the armed forces, MCOT (a Thai media conglomerate) and state agencies.

Assuming the bill passes smoothly through the lower house and then the Senate, it could be signed into law and take effect from the middle of this year.

FPO: 3G fees must reflect fair return to state

3G girlsMigration from 2G also imperils revenue

Licensing fees for new third-generation mobile licences should be priced to give the government at least an equivalent return to those offered through existing mobile phone concessions, according to Supa Piyajitti, the director-general of the Fiscal Policy Office.

Existing mobile phone concessions held by the three main operators – Advanced Info Service, DTAC and True Move – are structured as revenue-sharing agreements paying 20% to 30% of revenues to the state-owned TOT Corp and CAT Telecom.

And while the National Telecommunications Commission (NTC) has yet to announce final pricing for the 3G licence auction expected to take place next year, preliminary studies estimate the revenues generated for the government could be as low as 6.5% of operators’ revenues.

NTC officials last month announced a reserve price of 4.6 billion baht each for three 10 MHz licences, and 5.2 billion for one 15 MHz licence – down from 10 billion indicated earlier. Final prices will depend on the number of bidders and other terms set for the auction, now expected to take place at the earliest in February 2010.

Ms Supa said that in any case, the auction should be structured to provide compensation for the state at least equal to that offered through existing 2G concessions.
